A plaintiff must file a written complaint or petition to the District or Summary Court, depending on the amount of the alleged claim. The court fee must be paid at the time this is filed.
Normally you must also pay retainer fee to the attorneys to retain them for the specific litigation, or you must pay the hourly charged fees for each attorney working for you.
Attorneys must prepare the engagement agreement with the client and make the fee structure clear. The Court reviews the complaint, sends a copy of it to the defendant by mail, and gives notice to appear in Court by a certain date, designated as the first oral argument date. If the defendant does not appear for that date, the Court can make a default judgment. Accordingly, if you receive the above notice as a defendant, you will not have much time to retain an attorney or attorneys who can appear on the date on your behalf.
