Q5: Are there alternative dispute resolution procedures available in Japan?

Yes. There are certain procedures, including, mediation and arbitration or certain other special procedures which serve as ADR.
The Act to Promote Alternative Dispute Resolution was enacted in 2007, financial ADR, for resolution of disputes using mediators who have special knowledge, has proven popular in Japan. The ADR using such specialists exists for Construction disputes and normally, mandatory conciliation and mediation procedures are stated in the relevant contracts.

In addition, ADR for intellectual property disputes are also becoming popular in Japan since special knowledge is required to resolute them and mediators with specific experience and knowledge can provide services beneficial to the parties for comparatively quick resolution.
