Q2: How is the Japanese legal system outlined?

In Japan, real estate property rights are subject to the Civil Code of Japan. This Code regulates basic things such as the definition of ownership and joint ownership, the way property is assigned and the effects of registration. The purchase agreements of real estate are subject to the law of contracts in the same Code.

The rights and obligations of the purchaser and seller are provided under the law, but the parties concerned can set up additional agreements in a written contract, as long as they are not against any compulsory provisions under Japanese Civil Code. Thus if you enter into real estate transactions, the support of an experienced Japanese real estate lawyer is recommended.
